Warranties and Guarantees

Brothers Industrial Sales and Services limited (BISS) warrants that all goods furnished are free of all liens, encumbrances and security interests. Unless otherwise specified, all goods provided by BISS will be new and will respect the manufacturer’s warranty period; in addition all warranties prescribed by law will also be respected. Goods and services will conform to industry requirements and will be free from defects, except in case of manufacturing faults. All services provided by BISS will be performed by qualified and competent personnel in a professional manner using the highest standards of quality and workmanship.

All service completed and commissioned by BISS will immediately be deemed accepted and will become the customer’s responsibility. If issues arise thereafter, then the customer can access support through our service contract arrangement that is recommended and considered priority after each service/installation.

Buyers will obtain from BISS, vendors or subcontractors where applicable all available warranties and guarantees as given by manufacturer.

Should an external subcontractor or vendor commit an error that causes damages, the buyer may enforce this warranty against said subcontractor or vendor to resolve all such issues with the subcontractor/vendor.

Force Majeure

Neither party (BISS or the buyer) will be liable for delays in performance/damages caused by acts of God, strikes or labour disturbances or any other delays in performance or damages due to any contingency beyond Brothers Industrial Sales and Services (BISS) Limited’s control. In the event of any such occurrence, BISS will suggest a reasonable solution considered by BISS Directors and discuss with Buyers how to proceed.

Labour

Brothers industrial Sales and Service Limited (BISS)  will ensure we make all reasonable efforts to prevent and resolve any labour related disturbance that could impact our end customers as it relates to employees or subcontractors. If such a dispute occurs, BISS will work assiduously to resolve in reasonable time frame to minimize any disruption of Services. BISS will notify Buyers of any delays and suggest reasonable time frame to correct issues to get project back on track.

Legal

Brothers Industrial Sales and Service Limited (BISS) will not be responsible for any claims, losses, suits, damages, liabilities, settlements, expenses and costs (including without limitation attorneys’ fees and other costs of litigation) that  directly or indirectly arise from or relate to  any breach or violation of any term Agreement with Buyers or external Subcontractors, including any warranty or guarantee, being:

  • Any sickness, disease, death or injury to any person or persons, including without limitation those Injuries that result solely from Buyer’s or external Subcontractors negligence.

Damages to property (including loss of use thereof) of Buyer or others arising out of or in any way connected with Goods or performance of Services, including without limitation those that result solely from Buyer’s and external Subcontractors negligence.
